Marine Transportation and Carriage by Water

Many contracts pertaining to carriage of goods or people fall under admiralty jurisdiction.  Issues falling into this area of Maritime Law include charter party contracts and general average.  Charter parties are the contractual arrangements for the lease of the whole or a portion of a ship.  There are also agreements referred to as demise agreements and time charters that both deal with the contractual duties of parties involved in moving goods or people.  General average is sometimes referred to as the "natural law of the sea founded in equity".  This exists outside of the scope of marine insurance.  It allows for a ship owner to retain any cargo until the owner of said cargo pays that shipment's contribution to any general average occurrence happening during shipping.
